Subpart 5. Narrative.

 

The case against Bruce Dewitt was brought to the District Attorney's Office of Los Santos on grounds that Bruce Dewitt had violated the laws of the State of San Andreas; specifically unlawful possession of automatic weapons.

 

Subpart 6. Recommendation.

"It would seem the public defenders office is delayed. Does the defendant wish to seek a private lawyer or represent themselves? The defendant also has the option to pay for bail."

"Your Honor,

 

The case against Bruce Dewitt is comprised of prima facie evidence, whereby Mister Dewitt was found to be in possession of an automatic sub-machine gun., specifically a MAC-10. Under San Andreas law, the search of the Defendant was perfectly within the scope of the Stop and Frisk Act. Unless the Defense is able to produce evidence that would suppress the facts brought before this court, the District Attorney's Office motions a summary judgement be leveled."

"Well Your Honor, 

 

The defense would like to bring up a point shared to me by Mr. Dewitt. Before First Responders arrived Mr. Dewitt was being assaulted by Torey Benton, who even attempted sexually assaulting him by attempting to take off his pants. While held at gunpoint from Mr. Benton, at this point Mr. Dewitt had sustained injuries from this altercation which where he was just trying to ride his bike, where Mr. Benton interjected on his day.

 

This is where Mr. Nagashima came in to Dewitts' help and shot Mr. Benton, all while Mr. Benton was trying to take off Mr. Dewitt's pants he had fumbled his gun that was held onto Mr. Dewitt dropping it in his pants, this is where First Responders' stopped and frisked him. So Your Honor, the gun found on my client was not his and planted on him at the time of death of Mr. Benton.

 

Not to mention the Los Santos Police Departments' failure to tend to my clients injuries after his assault is very inhumane as he was roughed up by Mr. Benton, as well as the officers refused to read him his rights."

Any attorney would know that Law Enforcement Officers are never obligated to read any individual their rights, unless they plan to submit their statements as evidence for use in court. 

 

Unless the Defense can present tangible evidence to support these claims, that the weapons were planted somehow, then the Prosecution will ask this court to rule on the case and evidence provided thus far."

"Mr. Spade,

 

Don't you believe if this man was in possession of a firearm he would have been subject to Mr. Benton sexually assaulting him and allowing him to take his pants off and be pummeled by Mr. Benton? 

 

Do you not believe that if the firearm was on Mr. Dewitt he would've been able to wave off an attacker?

 

Since a firearm was not in his possession he did not even have the option to defend himself against the real armed assailant,"

"Does the defence have any evidence they wish to present to prove these claims they are making? If no evidence can be presented then I shall not be wasting any further time in this court room and we can wrap this up."

"Mister Scalise, Mister Dewitt is being charged for possession of the weapon which he was found to have on his person during the time of the frisk. Now unless you can provide this court room with evidence that the frisk was infact illegal then I see no reason to continue this and will move on to a summary judgement."
