The People charge the subject(s) with:

VC041 - Reckless Driving

TF007 - Felony Public Endangerment 

 

Are multiple misdemeanors stacked for a felonious conviction?

Officer Narrative of the events:

On April 21, 2019, Master Trooper Richards was patrolling down Pasadena boulevard heading eastbound. At around 23:00, a white 2018 BMW F90 M5 traveling westbound was spotted overtaking another vehicle at high rates of speed before passing Trooper Richard's cruiser. The vehicle had been switching lanes vigorously prior to passing the Trooper which indicated erratic behavior already. Richards immediately made u-turn and engaged his lights and sirens in an attempt to chase the vehicle, but the driver, David Whitefield, increased his speed even more after noticing the cruiser. In an attempt to lose the Trooper, the driver took a northbound turn onto Giggles street while still traveling at high rates of speed which led the vehicle to collide with the sidewalk and a pole. Trooper Richards quickly arrived following the crash and requested fire and medical for the driver and passenger. Whitefield was taken to the hospital for recovery where the staff were instructed to keep him there until he was discharged by Trooper Richards. In addition, the suspect was released from SEMC by an LSPD Sergeant the day following, despite having zero involvement in the investigation. Whitefield is currently at-large after being wrongfully discharged.

Airbags have been deployed, blocking every window's visibility.
Front Bumper has damage on the front-right side.

Dashcam from YANKEE-57's cruiser:

You'd see the cruiser driving down Pasadena at around 23:00. A few seconds later two white sedans could be seen coming the opposite direction with one sedan switching lanes aggressively before blowing past the cruiser at high rates of speed. The lights and sirens would engage as the cruiser makes a u-turn. Afterwards, the BMW would slowly fade out of sight before turning onto Giggles street. The cruiser would eventually catch up and turn onto Giggles as well before spotting the BMW as it's turned at 45 degree angle in the opposite lane of traffic. Smoke would be coming out of the engine and various bits and pieces of the frame would lay.

 

 

Subpart 5. Narrative.

 

The case against David Whitefield was forwarded to the District Attorney's Office on the grounds that the Defendant had violated San Andreas laws specifically, Felony Reckless Endangerment and Reckless Driving. The Prosecution wishes that the court review the evidence held against the defendant, and come to a swift judgment regarding the allegations against them.

"There is not much more to state other than the statement was gained from a witness, who was under the influence of medication that alter his accounts of the event in an unjust manner, given that he was just discharged from the hospital for his involvement in the accident."

"Motion for bail is granted at four thousand dollars and a full suspension for all motor vehicle licenses for the duration of this trial shall be enforced....Unless the Defense can provide clear and direct evidence that clearly provides objective reasonings for the account to be struck then the motion is denied.... The Defense may present their opening statements."

"Your Honor, the way this report is worded is greatly exaggerated. Technically anyone passing another vehicle in traffic, within legal limits, is considered "overtaking" a vehicle. There is no substance to the argument that it was done in a dangerous or aggressive manner, and driving aggressively to my knowledge is not against the law and is therefore just word play to make my clients actions seem worse than they were."

 

"Additionally, there is no proof my client sped up or attempted to evade police and if this is true, why was he not charged as such? If this is the main point of his being chased then that too is an issue and a great exaggeration."

 

"The way the report is worded is that the Trooper did not see the accident but rather arrived afterwards to see it, and the damage present on the vehicle is very minimal for the supposed speeds my client was driving. Regardless, an vehicular accident where no third party is injured is not illegal. In fact, car crashes themselves are not illegal. Why is my client being singled out? It is also worth noting there is a vehicle illegally parked which may have contributed to this crash."

 

"Again, if my client was such a threat and danger for evading and alleged reckless driving then why did the Trooper not follow up and instead my client was discharged from the hospital with no issues?"

 

"Furthermore, a precedent on alleged reckless driving has been set in the case of The State v. Huw Edwards and The State v. David Whitefield and we believe my clients actions do not warrant the charges."

"Your Honor, the witness who provided the statement is in the court room today with the medication prescription on his person. That is the only proof I can offer should you want to speak to him."

 

"Additionally, your Honor. Given the crippled public transportation system in the County I ask that my client be allowed to drive, perhaps with restrictions? Rather than be barred all together."

"Mister Olsson, if your witness willfully wishes to submit a written affidavit, the court will consider your initial motion to dismiss said evidence... In terms of license restrictions, the Court finds that it would be negligent to permit a driver charged with endangerment to continue to operate a motor vehicle freely and the initial rulings on bail shall be held."
