    District Attorneys Office & ESOC Investigation into the LSPD Office of The County Commissioner January 8th, 2019  Greetings Fellow Citizens!  On the 2nd of January, 2019. A concern was brought in by the District Attorneys Office regarding an increasingly high amount of former Los Santos Police and Sheriff's Department Officers, are re-applying to fill vacancies within the Police Department, some of which carry with them some concerning history. More specifically, concerning the resignations surrounding the "United States v. Spencer" case, where multiple command members of the Los Santos Police Department had resigned under reasons, some of which concern "differences between members of the judicial system; injustice and gross bias", some of who did not disclose their reasons. The aforementioned members were honorably discharged under Former Chief Justin Almeida, however some former officers were dishonorably discharged under similar circumstances. Due to this, County Commissioner approved a joint investigation between the District Attorneys Office, the Emergency Services Oversight Committee (ESOC), in addition to the County Council serving as an overseer. District Attorney Steven Spade, alongside Dr. Patrick Graham from the ESOC (who had served his part as an impartial party throughout the investigation) and other members of the ESOC instigated an investigation into the circumstances surrounding the resignations of Nathan Daniels, Michael Donnelly, Elizabeth Woods and Justin Almeida. The investigation initially included a review of particular Internal Affairs cases during Almeida's leadership. Upon later recommendations by the District Attorneys Office, this was extended to include current Internal Affairs policies and protocols. Whilst the Emergency Services Oversight Committee is in deliberation to determine their independent outcome, the District Attorneys Office is currently recommending the following: At this time, the District Attorney's Office is NOT recommending the discharge of any current employees of the Los Santos Police Department. It is the opinion of the District Attorney's Office that Michael Donnelly has served the Department recently without major issue, and has demonstrated to be a significant contributor to it's operational Capabilities. The District Attorney's Office will inquire into promotions of the individuals highlighted and the justifications behind them. It is recommended that both of the above employees should be monitored by a third party (or parties) in the form of bi-weekly action reports and summaries being forwarded to the District Attorney's Office & ESOC to ensure standards of duty are maintained for the foreseeable future. The District Attorney's Office believes that sufficient evidence has been brought forward to demonstrate that the discharges of M. Donnelly, E. Woods, N. Daniels, and J. Almeida, should not be deemed 'honorable' and recommends that all four discharges from Feb. 2017 amended to 'dishonorable.' The District Attorney's Office shall continue to investigate the possibilities of civil action being taken against Justin Almeida on grounds of negligence of duty/supervision, and plans to present it's case to the County Commissioner's Office if there is sufficient evidence to support it, prior to filing a formal complaint. The District Attorney's Office recommends that a joint effort between the ESOC, LSPD & DA's Office be made in order to improve the investigative capabilities, protocols and general direction of the Los Santos Police Department's Internal Affairs Bureau. The District Attorney's Office would be glad to formulate documentation to support this, working closely with the Office of the Chief of Police. With this being said, the County Council may pass a legislation or a resolution in consolidation with the findings of this investigation, affirming the proposed actions to be in the public's best interest. "I would first like to begin by stating that the 911 call did not specify any model, make, color, or vehicle type. Therefore, there is no way of knowing if these two vehicles are the one which was mentioned by a 911 caller. We believe that it's unfair to assume these vehicles were racing simply because they were travelling at high speeds. Additionally, "numerous" vehicles insinuates that there are many drivers partaking in this behavior. I would not consider two vehicles to be "numerous" and again, there is no way of knowing if these are the same two vehicles." "Furthermore, for a felony street competition charge to be valid one must provide proof of an organized or otherwise premeditated illegal street contest. The prosecution has offered no proof of this so we ask that this charge be dismissed." "To continue, I would like to argue that my client did not partake in public endangerment. To make this argument I would like to cite case law from The People v. Huw Edwards. In this case, we discover that Huw Edwards was travelling 150 mph in a 56 mph zone in the Downtown district of Los Santos. Mr. Edwards ripped through the major intersection between St. Lawrence street and Pasadena boulevard without a thought of yielding to traffic. Huw Edwards was not charged with TF007 and instead was charged with reckless driving and did not have his vehicle seized." According to the facts of the case, had a vehicle pulled out in front of Huw Edwards in the intersection, it would have taken him 1075.24 feet to stop. However, the Justice handling the case decided it was not an acute risk. Surely then in this case where my client was going slower than Huw Edwards, is not guilty. If Huw Edwards can go this fast through an intersection in Downtown Los Santos and not be charged for TF007, nor have his vehicle seized, then my client simply speeding on a vacated road is far less serious than what Huw Edwards did. As for the firearm charge, we believe this to be fruit of the poisonous tree as the arrest was not valid given the reasons I just stated and should also be dismissed." "And to conclude, I would like to point out that in the footage provided there was no dangerous lane switches or illegal over taking as alleged in the narratives."     Year In Review 2018

    Year In Review 2018 Community & Script Updates 2018 has been a fantastic year for OwlGaming and I wanted to take the time to thank everyone for continuing to play. Even if you aren't on the MTA server anymore it is nice to see the community grouping up and playing games together on teamspeak or our discord. If someone would be interested in hosting a game night, I would be interested in helping out and joining! Throughout the year we have made numerous rule changes. This year we launched a refresh of our UCP design to highlight the work we are doing on launching a GTAV server: The MTA server alone has had over 35 thousand lines of code changed in this last year: The V project with nearly just as much! Personally my favorite bit of content in 2018 has been the rise and success of Craazy's gang. Their IC updates and screenshots have been a welcome read! Media To have your media featured in the next newsletter, submit it on the #media channel on Discord! Stats 3,189 reports handled in the month of December! 45,173 reports handled in the year of 2018! (note: this does not include support tickets.) Concluding I can't wait to see what 2019 brings for OwlGaming.     "I see. Whilst I do find the precedent of The People v Huw Edwards to be bizzare, I do believe that it is of the upmost importance to look at the individual circumstances of each event. In the Defendant's circumstances here, all that can be proven is that he was travelling above the speed limit, however, this area is much more rural than the location Mr. Edwards' offence took place, and I may be inclined to agree with this. Further within the precedent overruled in the case of Eglis Priede v, The People, as noted by Chief Justice Vanderbilt, that 'posing a threat to property or life' cannot mean that of the Defendant, who at the time was evading Law Enforcement. I too, am unable to locate a point in the dash-cam clip provided that can be considered an illegal overtake or a dangerous lane switch, and so the narrative is the only form of evidence of such. And so, I am inclined to follow the precedent established by Justice Ross in the case of Edwards. I must add that penal code for Felony Street Competition states "Planned, organized and otherwise premeditated illegal street contests", meaning there must be some form of mens rea must be present, and so far, this Courtroom has only been presented with the actus reus. Unless there is evidence that displays this, beyond a shadow of a doubt, that there was some form of planning or organisation, then I may have to dismiss the individual charge. Though, does the Prosecution have anything further to present as evidence to this courtroom, or perhaps wishes to modify the charges set against the Defendant, at which point I could dismiss the former and present a new Notice of Action?"     2019 Emergency Service Contract Renewal & Budget Resolution WHEREAS, the County desires a Budget to be passed upon the swearing-in of County Commissioner James Bradford to prevent a prolonged County Government Shutdown. WHEREAS, the County desires the renewal of the Emergency Service Contracts which apply to the Los Santos Police Department (LSPD), the Los Santos Fire Department (LSFD) and the Saint Ernest Medical Center (SEMC). WHEREAS, the County desires the ability to evaluate, rectify or terminate the aforementioned Contract or Budget provided it meets the provisions outlined in the specific Contract. WHEREAS, the County identifies the following documents as the accurate and legal representation of the agreed Contracts and the terms within it: Chief of Police Employment Contract County Law Enforcement Services Contract County Fire, EMS & Coroner Services Contract WHEREAS, the County recognises the following sums as the 'Budget' for the CPQL, it's Departments and Sub Divisions per Calendar Month: NOW, THEREFORE, the County of Los Santos agrees as follows: The County establishes that the above contracts are not to be terminated, modified or tampered with unless the conditions within the individual contracts are met or by a unanimous request of the Council. The County establishes that the County Commissioner is to ensure that both the Budget and aforementioned Contracts are properly and lawfully carried out and executed. The County establishes that the aforementioned Budget is to remain in place unless there is a change in the occupier of the position of County Commissioner of Los Santos County.
